I've been trying to think of some example of a homo sacer (I think having a referent really lets me grasp the concept at hand with more depth, at least most of the time), and the only thing that keeps coming up in my head is the idea of a pirate (yes, of the Caribbean!).
I kept mulling over the quote on page 71: "It is not permitted to sacrifice this man, yet he who kills him will not be condemned for homicide." Is that not the case of pirates? I feel the Pirates of the Caribbean movies swerve from this logic in that they do represent Captain Jack Sparrow (and other pirates) shackled up about to hang (which one could argue is not the death penalty but a cleansing/purifying act -- as Agamben talks about on page 81 with regards to the gruesome //poena cullei//).
Anyhow, I feel like a pirate could be a good example of a homo sacer.
